Regulations defining the rules for using the HydroNexis system and website
1.1. These regulations define the terms of use of the HydroNexis system and the website available at www.hydronexis.com, hereinafter referred to as the "Service".
1.2. The owner and administrator of the Service and the HydroNexis system is HydroNexis company with its registered office in Ławy, 97-400 Ławy, hereinafter referred to as the "Service Provider".
1.3. Each user is required to familiarize themselves with these Regulations before using the Service.
1.4. Using the Service implies acceptance and commitment to comply with the rules of the Regulations.
2.1. Service - website available at www.hydronexis.com.
2.2. HydroNexis System - advanced SCADA system for managing pumps and pump aggregates in deep wells.
2.3. User - a natural person, legal entity, or organizational unit without legal personality using the Service or HydroNexis System.
2.4. Account - a collection of resources and permissions within the HydroNexis System assigned to a specific User.
2.5. License - the right to use the HydroNexis System under the terms specified in a separate license agreement.
3.1. Access to the informational part of the Service is free and does not require registration.
3.2. Some Service functions may be available only to registered Users with active Accounts.
3.3. The User agrees to:
4.1. Using the HydroNexis System requires concluding a separate license agreement with the Service Provider.
4.2. Detailed terms of use of the HydroNexis System, including price, license duration, and scope of rights, are specified in the license agreement.
4.3. The HydroNexis System and all its elements are the intellectual property of the Service Provider and are legally protected.

6.1. The Service Provider makes every effort to ensure that the Service and HydroNexis System function properly, but does not guarantee uninterrupted and error-free operation.
6.2. The Service Provider is not responsible for:
6.3. The Service Provider's liability to the User is limited to the amount of actual damage and does not include lost profits.
7.1. All intellectual property rights to the content contained in the Service and to the HydroNexis System, including copyrights and trademark rights, belong to the Service Provider or entities with which the Service Provider has concluded appropriate agreements.
7.2. Using the content placed in the Service or the HydroNexis System does not imply acquiring any rights to these contents or system.
7.3. Copying, modifying, or distributing content placed in the Service without prior written consent of the Service Provider is prohibited.
8.1. Detailed information regarding the principles of processing Users' personal data can be found in the Privacy Policy.
9.1. The User has the right to submit complaints regarding the functioning of the Service or HydroNexis System.
9.2. Complaints should be submitted electronically to: complaints@hydronexis.com or in writing to the Service Provider's registered office address.

9.4. The Service Provider processes the complaint within 14 days from the date of its receipt.
10.1. The Service Provider reserves the right to change these Regulations at any time. Changes come into effect on the day of their publication in the Service.
10.2. The Service Provider will inform Users with Accounts about significant changes to the Regulations via email.
10.3. If the User does not accept the changes to the Regulations, they have the right to discontinue using the Service or HydroNexis System.
10.4. In matters not regulated by these Regulations, the provisions of Polish law apply, in particular the Civil Code, Copyright and Related Rights Act, Act on Providing Services by Electronic Means, and Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).
10.5. Any disputes arising under these Regulations will be resolved by the court having jurisdiction over the Service Provider's registered office.
10.6. These Regulations come into force on 01.01.2025.
